Participation Rules for the DigiDems Forum

You are invited to participate in the DigiDems Forum. This is a shared resource, built by the Zinc Collective using open source “Discourse” software, that simplifies the structured interchange of electronic mail among cooperating participants. For the purposes of avoiding impermissible coordination under the Federal Election Campaign Act, please note that non-public information regarding federal candidates and party committees, and their plans, projects, activities, or needs, may be discussed on the DigiDems Forum.

These are the rules of the DigiDems Forum. Your use of the DigiDems Forum indicates your acceptance of these rules:

  • The objective of the DigiDems Forum is to promote the sharing of ideas, strategies and tactics for Democratic campaigns. The Forum also serves as a social space for campaign-embedded DigiDems participants. Valid topics for the DigiDems Forum may range from the profound to the mundane, from techniques to helping candidates win election to eating healthy in the process. The DigiDems Forum is what you make of it.
  • Everyone who participates is encouraged to post messages, and every invited participant can read them. You can also send private messages to other participants using the direct messaging feature of the Forum.
  • Messages cannot be anonymous or pseudonymous. The author of every message is automatically identified on it.
  • You can elect to receive notification emails from the DigiDems Forum immediately, in weekly summaries, or not at all.
  • All Forum discussions are public to Forum members but not available to non-members. They are confidential, but not secret. Speak freely here but to each other. If you wish to make a public or entirely private statement, please make it off this list.
  • The Chatham House Rule in this DigiDems Forum provides that participants may discuss the content of the discussion in the outside world, but they may not discuss who participated or identify what a specific individual said. You cannot copy any other participant’s messages outside this list without that writer’s express permission. This is known as a non-attribution rule that evolved early in the last century in England to facilitate a frank and honest discussion on major controversial or unpopular international issues by speakers who may not have otherwise had an appropriate forum to speak freely.
  • This list is moderated by Zinc Collective staff to ensure that discussions are not personally insulting, ad hominem, or angry. The goal is the exchange of ideas, not diatribes. Visualize what the U.S. Congress should be like.
  • There are discussions in the Forum that are explicitly marked private and viewable only to Zinc Collective staff and a few other invited participants. Those discussions are confidential to the participants and not subject to the Chatham House Rule. Please do not copy those messages without explicit permission.
  • You are encouraged to introduce yourself to other DigiDems Forum participants by posting a short description of yourself, your work, and the candidates you support. Please reply to the appropriate Topic in the ‘Introduce Yourself’ category to do so. People will trust other participants they learn to know.

The DigiDems Forum and the contents of this DigiDems․com website are the intellectual property of/and/or licensed technology owned and operated by Zinc Collective LLC (“Zinc Collective”), and are offered to you subject to your acceptance of the Participation Rules listed above. If you do not agree to become subject to those Rules, you may not use or access this website or the DigiDems Forum.

You are solely responsible for any content posted to the DigiDems Forum under your account. You must immediately notify Zinc Collective staff of any unauthorized uses of your account or any other breaches of security. Zinc Collective will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. With respect to any material you post on the DigiDems Forum (“Content”), you represent and warrant that:

The downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;

If your employer has rights to the Content, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content;

You have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to DigiDems Forum end users any required terms;

Your Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;

Your Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);

Your Content is not pornographic or obscene, does not contain threats or incite violence, and does not violate the privacy or publicity rights of any third party;

Your Content is not being advertised via unwanted electronic messages such as spam links on newsgroups, email lists, blogs and websites, and similar unsolicited promotional methods;

Your Content is not identified in a manner that misleads your readers into thinking that you are another person or company; and

You have, in the case of Content that includes computer code, accurately categorized and/or described the type, nature, uses and effects of the materials, whether requested to do so by Zinc Collective or otherwise.

All Content that you post to the DigiDems Forum is licensed to Zinc Collective LLC and its participants under a Creative Commons Attribution-NonCommercial-ShareAlike 3.0 Unported License (“CC-BY-SA”, last updated January 1, 2018). Zinc Collective has the right (though not the obligation), in Zinc Collective sole discretion, to (i) refuse or remove any content that, in Zinc Collective’s reasonable opinion, violates any Zinc Collective policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the DigiDems Forum and this website to any individual or entity for any reason, in Zinc Collective’s sole discretion.

You agree not to share or use any non-public information from the DigiDems Forum in any manner that would constitute or facilitate an impermissible coordinated communication as defined under the Federal Election Campaign Act, or in any manner that would otherwise constitute a violation of applicable federal, state, or local campaign finance laws.

By operating the DigiDems Forum and this website, Zinc Collective does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The DigiDems Forum and this website are provided “As Is”, without warranty or liability of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

You agree to indemnify and hold harmless Zinc Collective LLC, its contractors and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the DigiDems Forum or this website, including but not limited to your violation of this Legal Statement.
